Acceptance of Terms
By downloading, installing, or using the Onome application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app. You must be at least 13 years old to use this service.
Description of Service
Onome is a running and fitness application for creating and tracking interval workouts. The app provides GPS tracking, pace monitoring, and workout management tools. Onome is not a medical device and does not provide medical advice.
User Conduct
You agree not to: • Reverse-engineer, decompile, or disassemble the application • Use the app for any unlawful purpose • Attempt to interfere with the app's infrastructure or other users' access • Use the app while driving, cycling, or in any situation where distraction poses a safety risk
Intellectual Property
The app's content, design, code, and branding are the property of Onome and protected by applicable intellectual property laws. You retain full ownership of your workout data, fitness metrics, and any content you create within the app.
Health & Safety Disclaimer
Onome is not a substitute for professional medical advice, diagnosis, or treatment. You should consult a physician before beginning any exercise program. You assume all risks associated with physical activity while using the app. Always be aware of your surroundings while running. Do not rely solely on GPS data for navigation or safety purposes.
Third-Party Services
The app integrates with third-party services including OpenRouter, OpenAI, Google Maps, Sentry, and Expo. These services operate under their own terms of service. Onome is not responsible for third-party service availability, accuracy, or outages.
Disclaimer of Warranties
The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy of GPS data, pace calculations, distance measurements, or any fitness metrics provided by the app.
Limitation of Liability
To the maximum extent permitted by applicable law, Onome and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or damages arising from your use of or inability to use the app. Our total aggregate liability shall not exceed the amount you paid for the app.
Termination
We reserve the right to terminate or suspend your access to the app at any time for violations of these terms. You may stop using the app at any time by deleting it from your device.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Quebec, Canada.
Changes to Terms
We may update these Terms of Service from time to time. Changes will be delivered via app updates. Your continued use of the app after an update constitutes acceptance of the revised terms.
